SELLING YOUR LAND (refer to Customer Contract section 23 – see link below)
If you are selling your vineyard with BIL water, BIL has its own processes to transfer ownership of BIL shares and water contracts to the new owner. These are separate and in additional to the land sale processes.
• Invoices will continue to be sent to you until BIL’s transfer processes are completed.
• Transfers cannot be completed until all outstanding invoices have been paid.
If you are selling your vineyard without BIL water, please contact the office.
To transfer your BIL water to the new vineyard owner:
- Notify the BIL office that you are selling and arrange for collection of the following paperwork:
• Standard Transfer Form
• Deed of Assignment and Assumption
• Levy schedule (if applicable) - Return the following to the BIL office in original hardcopy format:
• Completed paperwork as listed above
• Original share certificate(s). If the originals are lost, request and complete a Lost Share Certificate declaration. All transferor(s) must sign this. The original share certificate(s) will then be cancelled.
• Note: On completion of the transfer, new share certificates will be issued to the transferee - Meter Reading
• Please contact the BIL office prior to settlement day to arrange reading of your meter and subsequent invoicing for water used. - Customers are required by the Water Amendment (Restoring Our Rivers) Bill 2023 (Cth) to provide complete and truthful information. Incomplete forms may be returned. Parties to the transaction must keep records for five (5) years of the price of the sale.
SELLING ALL OR PART OF YOUR WATER CONTRACT (refer to Customer Contract section 22 – see link below)
You are able to sell all or part of your water contract to another BIL Customer. Prior written consent must be obtained from BIL if the purchaser is not already a BIL customer. BIL may also need to determine if the infrastructure can supply the water to the new location without negatively impacting other Customers. Please discuss this with BIL in advance of agreeing to the sale of BIL water.

To transfer your BIL water to another Customer:
- Obtain prior written consent from BIL if the purchaser is not already a BIL customer.
- Obtain confirmation from BIL that the infrastructure can supply the water to the new location without negatively impacting other Customers.
- Notify the BIL office that you are selling and arrange for collection of the following paperwork:
• Standard Transfer Form
• Deed of Assignment and Assumption
• Levy schedule (if applicable) - Return the following to the BIL office in original hardcopy format:
